It is the responsibility of the surviving spouse or the person to be appointed as the personal representative of the decedent’s Estate to contact the appropriate county (county where the deceased lived prior to death) probate court office.

You may contact the proper court immediately after the death but the court must be notified within thirty days. If the deceased had no will you must wait five days from the date of death before contacting probate court.

Documents you need to take with you to probate court:

            Certified copy of the death certificate.

            Will of the deceased.
